These Terms of Use govern your access to and use of fengming.media (the "Website"), owned by Fengming Media Solutions LLC ("Fengming", "we"). By using the Website you accept these Terms. If you do not agree, please do not use the Website.

These Terms do not govern the use of our software products, which is subject to the SaaS Terms of Service, the End User License Agreement and the order form agreed with each customer.

1. Use of the Website

You may browse the Website and use its content for information purposes. You agree not to:

• use the Website for unlawful purposes or in breach of these Terms;
• attempt to access restricted areas, systems or data, or interfere with the security or operation of the Website;
• introduce viruses, malicious code or automated traffic intended to overload the Website;
• copy, scrape or extract content systematically without our written permission;
• send false information or third-party data without authorization through our forms.

2. Intellectual property

All content of the Website — including texts, graphics, the Fengming name and logo, the phoenix symbol, software, designs and their arrangement — is owned by Fengming or its licensors and is protected by intellectual property laws. No license is granted to you other than the limited right to view the Website. Third-party trademarks mentioned on the Website belong to their respective owners.

We make reasonable efforts to keep the information accurate and up to date, but it is provided for general information only. Descriptions of products, features and availability are indicative and do not constitute a binding offer. Commercial conditions are those set out in each order form or contract.

The Website may contain links to websites operated by third parties. We do not control them and are not responsible for their content, privacy practices or availability.

To the maximum extent permitted by law, Fengming will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or business opportunities, arising from your use of, or inability to use, the Website. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Governing law and jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute will be submitted to the state or federal courts located in the State of Wyoming. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence and may bring proceedings before its courts where that law allows it.
